Terms of use

These terms apply to the MemSpark app and the memspark.app service, operated by Caffeinated Code d.o.o. ("we"). Downloads from the App Store are additionally governed by Apple's standard Licensed Application End User License Agreement; where the two conflict for an App Store purchase, Apple's EULA controls.

The service

MemSpark is a spaced-repetition study app. The core study loop, importing decks, reviewing, scheduling, sync, shared decks, and basic statistics, is free, with 50 AI-generated cards a month and 100 MB of synced media. A paid tier, MemSpark Plus, available as a subscription or a one-time Lifetime purchase, adds 5 GB of synced media, 2,000 AI-generated cards a month, document, photo, audio and link ingest, image occlusion, review spreading and vacation planning, Insights, deck publishing, and related features.

Subscriptions

• MemSpark Plus is offered as an annual plan (with a 7-day free trial), a monthly plan, and a one-time Lifetime purchase. The exact price is always shown in the app before you buy, in your local currency; list prices are $39.99/year, $7.99/month, and $89.99 once for Lifetime (US). Lifetime unlocks Plus permanently on your Apple account; AI generation stays capped at 2,000 cards a month.
• Trial terms are exactly as shown at purchase: 7 days free, then the annual price. Cancel anytime, if you cancel before the trial ends, you are not charged.
• Subscriptions renew automatically until cancelled. Payment is charged to your Apple account; manage or cancel in iOS Settings → Apple Account → Subscriptions, at least 24 hours before the current period ends.
• Refunds for App Store purchases are handled by Apple at reportaproblem.apple.com.

Your content

Your decks, cards, and media are yours. You give us only the license needed to store and sync them for you. Do not upload content you have no right to use, and do not use MemSpark to distribute copyrighted deck content without permission.

AI-generated content

AI-generated cards can contain mistakes. Review generated cards before relying on them, especially for medical, legal, or safety-critical study. You are responsible for what you keep.

Fair use

AI generation on the free tier is quota-limited, and Plus is subject to fair-use limits that exist only to prevent abuse. Do not attempt to break, probe, or overload the service, resell access, or use it to build a competing dataset.

Warranty and liability

MemSpark is provided "as is", without warranty of any kind. To the extent the law allows, we are not liable for indirect or consequential damages; our total liability is limited to what you paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot lawfully be limited, or your statutory consumer rights.

Termination

You can stop using MemSpark and delete your account at any time in Settings. We may suspend accounts that break these terms; where reasonable we will warn you first.

Changes

If these terms change in a way that matters, we will say so in the app before the change takes effect. Continuing to use MemSpark after that means you accept the new terms.
